3. Texas Medical Records Privacy Act Compliance

Perfectly Mental complies with the Texas Medical Records Privacy Act, Texas Health and Safety Code Chapter 181 (“TMRPA”). The TMRPA provides protections for electronic health information beyond those required by federal HIPAA law. As a covered entity under the TMRPA, we are required to:

  • Obtain written authorization before releasing protected health information, with limited exceptions
  • Provide clients with a Notice of Privacy Practices describing how their health information may be used and disclosed
  • Notify affected individuals and the Texas Attorney General in the event of a breach of protected health information
  • Implement reasonable safeguards to protect the privacy and security of health information

4. Breach Notification

In the event of a breach of unsecured protected health information, Perfectly Mental will notify affected individuals without unreasonable delay and no later than 60 days after discovery of the breach, as required by applicable state and federal law. Notification will be provided by first-class mail or, if the individual has agreed to electronic notice, by email. If the breach affects 500 or more residents of Texas, we will also notify the Texas Attorney General.

For breaches affecting fewer than 500 individuals, we will maintain a log and report to the Secretary of the U.S. Department of Health and Human Services annually, as required by HIPAA.
